who purchases castings from seller from time to time.
Buyer agrees that the iron castings are sold only as iron castings. Seller specifically does not expressly or impliedly warrant the iron castings, their merchantability, or fitness for any purpose. Seller's liability is limited to repair or replacement value of castings.
Buyer assumes all risk and liability resulting from the use or misuse of said iron castings whether used singly or in combination with other goods.
Buyer agrees to indemnify Seller in the event of any loss incurred by Seller as a consequence of the use or misuse of the iron castings, and Buyer agrees to defend Seller against any suit brought by any third party for any reason based upon this agreement or upon the use or misuse of the iron castings bought by this Agreement.
